 THURSDAY, FEBRUARY15, 2018; 6:00 P.M.

LOCATED AT THE COLEMAN CITY HALL

200 W. LIVEOAK, COLEMAN, TEXAS 76834

 

A regular meeting of the City Council of the City of Coleman will be held on Thursday, February 15, 2018 at 6:00 P.M.  The following subjects will be considered by the City Council and may be considered in any order that is most convenient for the City Council.

I.                CITY COUNCIL MEETING CALLED TO ORDERMAYOR, TOMMY SLOAN:

 

II.             INVOCATION MAYOR, TOMMY SLOAN:

 

(THE MAYOR MAY CALL ON ANYONE HE MAY CHOOSE TO GIVE THE INVOCATION.  THE MAYOR MAY ALSO CALL ON ANYONE IN ATTENDANCE WHO MAY WANT TO GIVE AN INVOCATION ON BEHALF OF ANY OTHER RELIGION OR RELIGOUS BELIEFS)

 

III.           PLEDGE OF ALLEGIANCE – MAYOR, TOMMY SLOAN:

V.              CONSENT AGENDA – MAYOR, TOMMY SLOAN:

 

(THE CITY COUNCIL MAY APPROVE ALL OF THE CONSENT AGENDA ITEMS WITH ONE MOTION).

 

1.     The City Council may consider, discuss, and/or take actions regarding the approval of the minutes of the City Council Meeting conducted on January 4, January 11, and January 18, 2018  Karen Langley, City Secretary.

 

2.     The City Council may consider, discuss, and/or take actions to approve the Code Enforcement report for the month of January, 2018– Fire Chief, David Martinez.

 

3.     The City Council may consider, discuss, and/or take actions to approve the Police Department report for the month of January, 2018 – Police Chief, Anthony Smith.

 

4.     The City Council may consider, discuss, and/or take actions to approve the Municipal Court Report for the month of January, 2018 – Judge, Robert J. Nash.

 

5.     The City Council may consider, discuss, and/or take actions to approve the Legal Fees for the month of January, 2018 – City Manager, Paul Catoe.

 

6.     The City Council may consider, discuss, and/or take actions to approve the Lake Level Reports for the Hords Creek Reservoir and Lake Coleman Reservoir for the month of February, 2018 – City Manager, Paul Catoe.

VI.           OLD BUSINESS:

 

1.     The City Council may consider, discuss, and/or take actions regarding the  approval of a presentation of a cemetery report regarding recent fund raising activities, the new entrance gate, landscaping activities, and future goals for the spring of 2018 – Mayor, Tommy Sloan and Ann Watson.

 

2.     The City Council may consider, discuss, and/or take actions regarding the approval of a new inter-local agreement between the City of Coleman and Coleman County for the new Law Enforcement Facility – Mayor, Tommy Sloan, Assistant City Manager, David Martinez, and City Attorney, Pat Chesser.

 

3.     The City Council may consider, discuss, and/or take actions to approve Resolution No. 18-03 regarding the land reimbursement for the TxDOT Aviation Project for the City of Coleman Municipal Airport – Mayor, Tommy Sloan and City Manager, Paul Catoe.

 

4.     The City Council may consider, discuss, and/or take actions to approve Resolution No. 18-04 regarding the Construction Phase of the TxDOT Aviation Project for the City of Coleman Municipal Airport – Mayor, Tommy Sloan and City Manager, Paul Catoe.

 

VII.         NEW BUSINESS:

 

1.     The City Council may consider, discuss, and/or take actions to approve the proposed schedule for the new Water Treatment Plant as funded through the U.S.D.A, Rural Development – Mayor Tommy Sloan and Allen Phillips P.E. representing Jacob & Martin LLC.

 

2.     The City Council may consider, discuss, and/or take actions to discuss the feasibility to relocate the Fiesta De La Paloma Festival back to the downtown area beginning in the fall of 2018 – Mayor, Tommy Sloan and Mary Griffis, Executive Director of the Coleman Chamber of Commerce.

 

3.     The City Council may consider, discuss, and/or take actions to approve a lease between the Type 4-A Coleman Economic Development Corporation and the Coleman Chamber of Commerce providing for a reimbursement in an amount not to exceed $35,200.00 to the Coleman Chamber of Commerce for building repairs, and a monthly lease payment of $1,500.00 to provide general office space and services for the Type 4-A CEDC – Mayor, Tommy Sloan and Herman Law, President of the Type 4-A CEDC.

 

4.     The City Council may consider, discuss, and/or take actions to approve the Racial Profiling Report/Tier One for the Coleman Police Department for the calendar year 2017Mayor, Tommy Sloan and Police Chief Anthony Smith.

 

5.     The City Council may consider, discuss, and/or take actions to approve the Racial Profiling Report/Exempt for the Lake Coleman Police Department for the calendar year 2017Mayor, Tommy Sloan and Police Chief Wallace Dobbins.

 

6.     The City Council may consider, discuss, and/or take actions to approve Resolution Number 18-05 approving a grant by the Type 4-B Coleman Community Coalition in the amount of $5,000.00 to Central Texas Opportunities to provide assistance with updating a meter loop, leveling the structure, plumbing and general rehabilitation of the structure acquired by the Central Texas Opportunities that is located at 205 and 207 N. Frio, Coleman Texas – Mayor, Tommy Sloan and Kim Little Executive Director of the Type 4-B CCC.

 

7.     The City Council may consider, discuss, and/or take actions to approve a request by the Coleman Municipal Airport to conduct a Fly–In on April 21, 2018Mayor, Tommy Sloan and Airport Manager, Randy Long.

 

8.     The City Council may consider, discuss, and/or take actions to approve a request to allow the United States Airforce to temporarily set up a 40’ long tractor trailer unit at the Coleman Municipal Airport which will simulate surface to air threats – Mayor, Tommy Sloan, Randy Long, and City Attorney, Pat Chesser.

 

9.     The City Council may consider, discuss, and/or take actions to approve Resolution Number 18-06 regarding the approval of a new lighting contract for the installation of new street lights for Neches Street to be installed by the Texas Department of Transportation and maintained by the City of Coleman – Mayor, Tommy Sloan, City Manager, Paul Catoe, and City Attorney, Pat Chesser.

 

10.  The City Council may consider, discuss, and/or take actions to approve a free religious concert at the Gazebo at the City Park which is being organized by Myra Lipinski and will be conducted from 1:00 P.M. to 4:00 P.M. on May 19, 2018 – Mayor, Tommy Sloan and City Manager, Paul Catoe.

 

11.  The City Council may consider, discuss, and/or take actions to cancel the next meeting scheduled for March 1, 2018 should circumstances warrant as per the provisions outlined in Section 2.11 of the City Charter and to then call a regular meeting to be scheduled for March 15, 2018Mayor, Tommy Sloan.

 

VIII.      MAYOR AND COUNCIL COMMENTS:    

 

THE CITY COUNCIL MAY DISCUSS AND/OR TAKE ACTIONS REGARDING ANY ITEM LISTED ON THIS AGENDA.  (ONLY THOSE ITEMS LISTED MAY BE PRESENTED AND DISCUSSED BY THE CITY COUNCIL)

 

1.     Recognition of Karen Langley for her recertification as a Texas Registered Municipal Clerk on January 25, 2018 – Mayor, Tommy Sloan.

 

IX.           STAFF COMMENTS:

 

THE CITY COUNCIL MAY DISCUSS AND/OR TAKE ACTIONS REGARDING ANY ITEM LISTED ON THIS AGENDA. (ONLY THOSE ITEMS LISTED ON THE AGENDA MAY BE DISCUSSED BY THE CITY COUNCIL)

 

1.     The City Manager may present a status report update on the request of the City Council to contact area communities regarding a comparison study – Mayor, Tommy Sloan and City Manager, Paul Catoe.

 

2.     The Chief of Police may present a status report regarding the possibility of seeking a grant for a new police interceptor vehicle – Mayor, Tommy Sloan and Chief of Police, Anthony Smith.

 

X.              HEARING OF VISITORS CONCERNING MATTERS NOT ON THE AGENDA – MAYOR, TOMMY SLOAN: (Visitors shall be limited to no more than (5) five minutes to address the Council.)

 

In accordance with Section 551.042 of the Texas Government Code, an inquiry made at a meeting shall be conducted as follows:

 

(a.) If at a meeting of a governmental body, a member of the public or the governmental body inquiries about a subject for which notice has not been given as required by this subchapter, the notice provisions of this subchapter do not apply to:

 

1.     A statement of a specific factual information given in response to the inquiry; or

2.     A recitation of existing policy in a response to the inquiry.

 

(b.) Any deliberation of or a decision about the subject of the inquiry shall be       limited to a proposal to place the subject on the agenda for a subsequent meeting.   

 

Note:  According to Section 5. (A.), of the Council Meeting Procedures the City Council respectfully request that prior to appearing before the City Council, the visitor or member of the public has made every attempt to resolve the problem through Administrative Channels, if appropriate. The Mayor may want to address this issue prior to allowing individuals to speak.

 

XI.           EXECUTIVE SESSION:

 

1.     The City Council may enter Executive Session to discuss personnel matters related to the annual evaluation of the City Manager pursuant to Section 551.074 of the Government Code and to discuss legal matters with the City Attorney pursuant to Section 551.071 of the Government Code – Mayor, Tommy Sloan.

 

2.     Upon returning to open session, the City Council may take whatever actions as they may deem appropriate regarding items discussed in Executive Session – Mayor Tommy Sloan.

 

XII.        ADJOURNMENT OF CITY COUNCIL MEETING:      TIME ____________

 

The City Council of the City of Coleman reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any of the matters as listed above, as authorized by Texas Government Code Sections: 551.071 (Consultation with the City Attorney), 551.072 (Deliberations about Real Property, 551.073 (Deliberations about Gifts and Donations) 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices) and 551.087 (Economic Development).

 

I, Karen Langley do hereby certify that the above notice of meeting of the governing body of the City of Coleman, Texas is a true and correct copy of the said notice and that a said copy of this notice was then posted on the front window of the City Hall of said City in Coleman, Texas in a location convenient and readily accessible to the general public at all times, and said notice was posted on February 12, 2018 at _________P.M. and remained so posted continuously at least 72 hours preceding the scheduled time of said meeting.
